The purpose of this Terms of Services is to define the rights, duties and responsibilities between the corporation (will be referred as ‘Gretech’) and the users regarding the use of Gretech’s websites (www.gomlab.com), applications and services (GOMplayer, GOMencoder and software that are properties of GOM or Gretech brand) accessible through the websites and sub-domains.
1) To use the ‘Services’, the user must first agree to the ‘Agreement’. If the user does not agree to the ‘Agreement’, he or she cannot use the ‘Services’.
2) This Terms of Service can be found at the bottom of www.gomlab.com page and is displayed at the time of www.gomlab.com member registration, exercising its effect with following methods.
3) If (a) the user has not reached the legal age to make a valid agreement with Gretech, or (b) the user is legally not allowed to use ‘Services’ due to the laws of the U.S. or other countries (areas where the user is residing in or using the ‘Services’ in), the user cannot use the ‘Services’ and agree to the ‘Agreement’.
4) ‘Gretech’ can make changes to the Terms of Service when reasonable reasons arise. When changes are made to the Terms of Service, ‘Gretech’ will list the applied date and reasons for the changes with the up-to-date Terms of Service on the initial service page 7 days prior to the applied date and will keep the notification on the page for a substantial amount of time. E-mails about the revised Terms of Service will be sent to regular members. It will be regarded that the user has agreed to the revised Terms of Service if he or she continues to use the services after the applied date of the revised Terms of Service.
5) If the user does not agree to the amended Agreement, he or she can request for termination. If the user does not express any disagreement against the amendment within the 7 days from the time of Agreement emendation and continues to use the service, it will be considered that the user agrees to the amendment of the Agreement.
6) Individual components (Application, Software, Webpage, Contents and etc.) included in the ‘Services’ contain separate documents that define the rights, duties and responsibilities between the individual components and the users. If there are contradictions or conflicts between the contents of the individual documents and the Terms of Services, (regarding individual components) the contents of the separate documents will take precedence.
7) The Corporation will not be held reliable for damages occurred to the user who fails to observe the changes made to the Agreement.
1) In case ‘Gretech’ has provided you with a translation of the English language version of the Terms of Services, then you agree that the translation is provided for your convenience only and that the English language versions of the Terms will govern your relationship with 'Gretech'.
2) If there is any contradiction between the English language version of the Terms of Service and the translated version, then the English language version shall take precedence.
1) ‘Gretech’ has subsidiaries and affiliated legal entities around the world (will be referred as ‘Subsidiaries and Affiliates’). Sometimes, these companies will be providing the Services to you on behalf of Gretech itself. You acknowledge and agree that Subsidiaries and Affiliates will be entitled to provide the Services to you.
2) ‘Gretech’ is continuously innovating in order to provide the best possible experience for its users. You are aware and agree that the form and nature of the ‘Services’ which ‘Gretech’ provides may change from time to time without prior notice to you.
3) As part of this continuing innovation, you acknowledge and agree that ‘Gretech’ may stop (permanently or temporarily) providing the ‘Services’ (or any features within the ‘Services’) to you or to users generally at the sole discretion of ‘Gretech’, without prior notice to you. You may stop using the Services at any time. You do not need to inform ‘Gretech’ when you stop using the ‘Services’.
4) You acknowledge and agree that if ‘Gretech’ disables access to your account, you may be prevented from accessing the ‘Services’, your account details or any files or other content which is contained in your account.
5) You acknowledge and agree that ‘Gretech’ can any time at its discretion set the fixed upper limit on the number of transmissions you may send or receive through the ‘Services’ or on the amount of storage space used for the provision of any ‘Service’.
1) The user acknowledges and agrees that ‘Gretech’ owns copyright and intellectual property rights regarding ‘Services’ in all the countries where the rights are registered (and even in the countries where those rights are not registered).
2) All copyright and intellectual property rights of the contents created by ‘Gretech’ in relation to the ‘Services’ are properties of ‘Gretech’.
3) The copyright and intellectual property rights of the contents related to the ‘Services’ that are offered by other companies are the properties of the companies providing the contents.
4) Unless the user has been specifically permitted to do so in a separate agreement with ‘Gretech’, the user agrees not to modify, rent, lend, sell, distribute all the contents (all or parts of it) related to the ‘Services’ and cannot create a secondary content based on the contents.
5) The user will continue to possess the copyright and intellectual property right of all the content submitted, notified or displayed by the user through or on the ‘Services’.
6) By submitting, posting or displaying the content you give ‘Gretech’ a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to reproduce, adapt, modify, translate, publish, publicly perform, publicly display and distribute any content which you submit, post or display on or through, the Services. This license is for the sole purpose of enabling ‘Gretech’ to display, distribute and promote the Services and may be revoked for certain Services as defined in the Additional Terms of those Services.
7) You agree that this license includes a right for ‘Gretech’ to make such content available to other companies, organizations or individuals with whom ‘Gretech’ has relationships for the provision of syndicated services, and to use such content in connection with the provision of those services.
8) The user guarantees that all the created contents that were submitted, posted or displayed on or through the ‘Services’ by the user do not infringe upon the rights of others regarding copyright and intellectual property rights (disregards whether or not such right is registered and targets all the countries where such rights could exist) and will be responsible for all the conflicts rising from the issue.
9) Unless the user has agreed otherwise in writing with ‘Gretech’, the user agrees that he or she is responsible for protecting and enforcing rights over the content created by the user and that ‘Gretech’ has no obligation to protect such rights on behalf of the user.
1) In order to access certain ‘Services’, you may be required to provide information about yourself (such as identification or contact details) as part of the registration process for the ‘Service’, or as part of your continued use of the ‘Services’. You agree that any registration information you give to ‘Gretech’ will always be accurate, correct and up to date.
2) The user agrees to use the ‘Services’ only for purposes that are permitted by (a) the Terms of Service and (b) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions (including any laws regarding the export of data or software to and from the United States or other relevant countries).
3) The user agrees not to access (or attempt to access) any of the ‘Services’ by any means other than through the interface that is provided by ‘Gretech’, unless he or she has been specifically allowed to do so in a separate agreement with ‘Gretech’.
4) The user agrees not to participate in activities that interrupt the ‘Services’ (or servers and networks that are connected to the ‘Services’).
5) Unless the user has been specifically permitted to do so in a separate agreement with ‘Gretech’, the user agrees not to reproduce, duplicate, copy, sell, trade or resell any of the components of ‘Services’ for any purpose.
6) The user agrees that he or she is solely responsible for (and that ‘Gretech’ has no responsibility to the user or to any third party for) any breach of the user’s obligations under the Terms of Service and for the consequences (including any loss or damage which ‘Gretech’ may suffer) of any such breach.
7) The user cannot use the information related to the copyright and intellectual property right of ‘Gretech’ or service providers acquired by using the ‘Services’ offered by ‘Gretech’ to copy, send, publish, distribute, broadcast and etc or allow a 3rd party to use such information.
8) The user agrees and understands that he or she is responsible for maintaining the confidentiality of passwords associated with any account the user uses to access the ‘Services’.
9) The user agrees that he or she will be solely responsible for all activities that occur under the user’s account.
10) If you become aware of any unauthorized use of your password or of your account, notify ‘Gretech’ immediately.
1) For information about the data protection practices of ‘Gretech’, please read our ‘Privacy Policy’ provided in the ‘Services’. This policy explains how ‘Gretech’ treats user’s personal information, and protects user’s privacy, when the user uses the ‘Services’.
2) The user agrees to the Gretech’s use of his or her data in accordance with the ‘Privacy Policy’.
1) ‘Gretech’ must do its best to perform the fulfillment of right and duty defined by the Terms of Agreement.
2) ‘Gretech’ must possess a protection system to protect personal information (including credit information) to allow the users to safely use the ‘Services’ and must notify and uphold the ‘Privacy Policy’.
3) ‘Gretech’ must do its best to resolve a user’s suggestion or complaint about the use of ‘Service’s if it is regarded as just. ‘Gretech’ delivers the process or the result about the suggestion or the complaint through the forum or e-mail.
4) ‘Gretech’ will make a compensation based on a reasonable standard if the user has experienced damage even after following the duties defined by the Terms of Service.
5) ‘Gretech’ will do its best to stop the spread of damage (revise, delete, explain) if a third party is damaged by the ‘Services’.
6) ‘Gretech’ will do its best to provide related information required by a third party if the third party is damaged by the ‘Services’ as long as it does not infringe upon others’ rights.
1) If the user falls under one of the following reasons, ‘Gretech’ can limit or terminate the user’s right to ‘Services’ use. If the following reasons is illegal or violates any laws, ‘Gretech’ can reported the IP address of the uploaded to related authorities.
2) If the contents submitted, posted or displayed by the user on or through the ‘Services’ fall under one of the categories below, ‘Gretech’ can modify or remove the contents without the user’s agreement. If it is illegal or violates any laws, will be immediately deleted and the IP address of the uploaded reported to authorities. Violating these terms will result in termination of your ability to upload further contents.
3) The user agrees that ‘Gretech’ has the right to make inspections and reviews on, prevent duplication (flag) of, and filter, modify, reject, or remove contents submitted, posted, or displayed on and through the ‘Services’ by the user to prevent the contents from falling under the above categories 1) and 2).
4) The user acknowledges that while using the ‘Services’ he or she can be exposed to contents that can cause disgust, are rude, or offensive and understands that he or she can take the burden of risks resulting from such contents.
1) Parts of the ‘Services’ are supported by advertising revenue and may display advertisements or promotions. These advertisements may be targeted to the content of information stored on the ‘Services’, questions made through the ‘Services’ or other information.
2) The manner, mode and extent of advertising by ‘Gretech’ on the ‘Services’ are subject to change without specific notice to the user.
3) As compensation to the access and use of the ‘Services’ offered by ‘Gretech’, the user agrees that ‘Gretech’ may place such advertising on the ‘Services’.
4) The user agrees that ‘Gretech’ can post advertisements on software screen, homepage, e-mail and etc. regarding the offer of ‘Services’. Users who have agreed to receive advertisement e-mail can choose not to receive them from ‘Gretech’.
1) ‘Gretech’ will not be responsible for the ‘Services’ that could not be provided due to an emergence of war, natural disaster, national emergency or any other unavoidable reasons that will deter ‘Gretech’ from providing normal ‘Service’s.
2) ‘Gretech’ is not reliable for any losses related to the ‘Services’ resulting from the abnormal offer of services provided Internet service providers or electricity service.
3) ‘Gretech’ is not reliable for any damage resulting from pre-notified repair, replacement, regular maintenance, construction related to ‘Services’ and other unavoidable reasons.
4) ‘Gretech’ is not reliable for the validity and accuracy of the information, data and facts provided by the user related to the ‘Services’.
5) ‘Gretech’ is not reliable for problems resulting from the computer environment of the user or network environment that are not the faults of ‘Gretech’.
6) ‘Gretech’ is not reliable for conflicts based on the ‘Services’ between the users or the user and a third party.
7) ‘Gretech’ is not reliable for the unavailability of the ‘Services’ use during the maintenance period due to the pre-notified maintenance of the ‘Service’s conducted to provide stable ‘Services’
8) The user fully acknowledges and agrees that the risk and burden of using the ‘Services’ lies entirely on the user and the ‘Service’s are offered ‘as is’ and ‘are provided to use’.
9) All the data acquired or downloaded through the use of ‘Services’ is acquired at the user’s own risk and burden, and the user is reliable for any loss or damage to the device or data resulting from the download of such data.
10) ‘Gretech’ denies any warranty or term for the information, advice, dictation that are not written in the ‘Agreement’ but acquired (implied or not implied) through the use of ‘Services’.
11) ‘Gretech’ cannot be held liable for any damages. All data, photographs, messages, graphics, comments, text, tags, or other materials, are the sole responsibility of the person from whom such Content originated. The user, and not ‘Gretech’, are entirely responsible for all Content that you upload, post ‘Services’. ‘Gretech’ does not control the Content posted and does not guarantee the accuracy or integrity of such Content.
1) As a general rule, if a law suit has been made against ‘Gretech’, it will be tried at a competent court that has the jurisdiction over the location ‘Gretech’ headquarters is in.
2) If some countries did not acknowledge the jurisdiction of the competent court governing over the location of ‘Gretech’ headquarters, only the legal limits set by the user’s country will be applied to the user and the responsibility of ‘Gretech’ will be limited to the maximum bounds allowed by the law of the related country. However, in any cases ‘Gretech’ can apply for a preservative measure or a similar form of emergent legal relief measure in all countries.
3) When using the ‘Services’, the user may use a service or download a piece of software, or purchase goods, which are provided by another person or company. Use of these other services, software or goods may be subject to separate terms between you and the company or person concerned. If so, the Terms of Service do not affect your legal relationship with these other companies or individuals.
4) If any court of law, having the jurisdiction to decide on this matter, rules that any provision of these Terms of Service is invalid, then that provision will be removed from the Terms of Service without affecting the rest of the Terms of Service. The remaining provisions of the Terms of Service will continue to be valid and enforceable.
(Effective Date) This Terms of Services will be effective starting on the date of November 4th, 2009.
